Dumpster Ordinance

NOTICE IS GIVEN that the Exeter Borough Council will consider the following ordinance amendment at its regular public meeting on Tuesday, March 6, 2017, 7 p.m. at the Exeter Borough Building, 1101 Wyoming Ave, Exeter, PA .Amendment to Dumpster Ordinance. Council of the Borough of Exeter has found that the implementation of Ordinance No. 3 of 2008, related to Dumpsters has not fully addressed the safety and welfare issues for which the Ordinance was implemented. By this Ordinance of Amendment, Council does hereby amend said Ordinance No. 3 of 2008 to adopt modifications to address such safety and welfare issues. 1. Section II, Paragraph 1 is hereby revoked and shall be replaced as follows: No persons shall place a Dumpster on any public street, alleyway, right of way or publicly owned property, without first obtaining from the Borough Zoning Office an application for permit, paying the permit fee and is issued a permit. The exact location of the placement of the Dumpster shall be clearly identified on the application, showing the name of the street on which the Dumpster is to be placed, its measured proximity to driveways and road entrances, and the Dumpster’s size, indicating height, width, volume and length. The permit application fee shall be $40.00 per Dumpster, and such fee may be increased from time to time by Resolution of the Exeter Borough Council. All applications for permits shall be approved or rejected within five (5) days of the submission of the application. 2. Section II, Paragraph 2 is hereby revoked shall be replaced as follows: The permit shall allow the placement of a Dumpster for a period not to exceed one (1) month in duration. If the applicant requires additional time, or if the Dumpster shall remain beyond 30 days, the permit holder shall be required to obtain an additional permit and/or permit renewal and pay and additional permit fee of $40.00. A new permit shall be required for every 30 day period during which a Dumpster will be placed. 3. Section II, Paragraph 3 is added as follows: Any permits granted pursuant to this Ordinance shall satisfy the requirements of the Borough of Exeter only. It shall be the responsibility of the applicant to satisfy any requirements of the Commonwealth of Pennsylvania or other agencies or governmental entities in regards to placement of Dumpsters on public rights of way. 4. Section III, Paragraph 1 A. is hereby revoked and shall be replaced as follows: Reflective paint and/or material shall be placed on all corners of Dumpsters subject to this ordinance. Sufficiently sized reflectors shall be placed on all four sides of the Dumpster. Every Dumpster shall be required to have at least one battery operated flashing emergency light, to be installed on the side of the Dumpster closest to the road, which light shall continuously operate for the duration of the placement of the Dumpster. 5. Section III, Paragraph 1 D. is added as follows: No Dumpster shall be placed so as to obstruct private driveways, or to block access by any resident to their property. No Dumpster shall be placed in any location which will create a safety risk or significantly impair the line of sight for drivers of vehicles at intersections or otherwise entering the public right of way from public or private driveways. Dumpsters placed on the public right of way shall be placed directly in front of the address or property for which they are providing service, unless it is impracticable to do so as determined by the Zoning Officer. ALL remaining provisions of Ordinance No. 3 of 2008, and any subsequent amendments which do not contradict the herein Amendment shall remain in full force and effect. RAYMOND A. HASSEY, ESQ.
